Wills and Probate

Wills

We can help you preserve your assets for future generations and can advise you on the best ways to plan for your future.

We will advise you on how best to ensure that your assets are distributed in accordance with your wishes.

We have extensive experience in advising clients as to the most tax efficient of leaving assets under your Will or through Trusts created in your lifetime.

Our Will drafting service is tailor-made to each individual client and takes your individual tax planning and other financial objectives into account. We endeavour to provide clear and comprehensive advice every step of the way.

In addition, we consider assets forming part of an estate for inheritance tax purposes and offer advice upon the most efficient structures, if applicable.

We specialise and prepare bespoke Wills for:

  • Married couples;
  • Unmarried couples;
  • Single parents;
  • Individuals or couples with children;
  • Individuals with business assets;
  • Individuals with foreign assets and domicile issues;
  • Individuals with vulnerable beneficiaries;
  • Individuals contemplating divorce;
  • Wills incorporating trusts for inheritance tax planning and to ring fence assets to protect beneficiaries;
  • Advise on the intestacy rules

Probate

We assist families with dealing to navigate the rules governing collecting assets after the death of a loved one. Our advice extends to the complex rules should a loved one die intestate (without making a valid Will).

We aim to offer and deliver efficient and practical help at a difficult time with a view of relieving you of an often-complex process and ensure the Deceased’s wishes are fulfilled with minimum difficulty and maximum efficiency.

When a relative dies without leaving a valid Will we can apply for Letters of Administration, assist in dealing with the administration of the estate, locating beneficiaries and relatives who may be eligible to administer the estate.

We work at a pace to suit the individual and have a breadth of experience covering, but not limited to, the following areas:

  • Identification of assets forming part of the estate;
  • Obtaining formal valuations as at the date of death for inheritance tax purposes;
  • Drafting all the required documents to obtain a Grant of Probate or Grant of Letters of administration
  • Identifying the Inheritance tax payable and any planning measures to mitigate such tax
  • Identifying Income and Capital Gains tax requirements and liaising with accountants where required to fulfil such liabilities
  • Preparation of the relevant HMRC documents for Inheritance Tax purposes
  • Liaising with HMRC as to the inheritance tax payable and obtaining clearance from HMRC
  • Dealing with requirements to transfer assets to the beneficiaries
  • Communicating with beneficiaries
  • Advising Executors and Trustees on their duties and responsibilities
